The first item considered was Committee Report No. 201 from the Committee on Laws, Rules and Policy Formulation, the Committee on Barangay Affairs, and the Committee on Police, Fire, Public Safety, and Illegal Drug Prevention, as presented by Honorable Jackielyn Krystyl C. Bana, relative to Referral No. 15cc-0295.Through a PowerPoint presentation, the Committee Chair thoroughly discussed the "whereas" clauses of the proposed ordinance and explained its provisions section by section, including the Definition of Terms and the Exception Clause. She emphasized the exceptions relating to age, venue, expression through fashion, culture, and the arts, and as necessary due to livelihood.

During the period of discussion, Honorable Ariel J. Lim, Jr. raised a concern regarding homeless and indigent individuals, questioning whether the proposed ordinance might be perceived as anti-poor in a situational basis where they cannot afford to buy clothing’s and sought clarification from the proponent on how apprehensions would be carried out under those circumstances. In response, Honorable Jackielyn Krystyl C. Bana explained that clothing is now generally affordable, with many at “ukay-ukay” items at minimal cost. She further emphasized that poverty, in itself, should not be reason for a situational exemption as it will be an absurd provision to the proposed ordinance. As for the imposition of penalties, Honorable Jackielyn Krystyl C. Bana clarified that there is no warning but instead the 1st offense will directly be implemented. She also explained the changes with the addition of the word “naked” in the title along with the definition of terms so as not to leave the interpretation to the discretion of the apprehending officer. With Honorable Ariel J. Lim, Jr. yielding, the motion of the Committee Chair which was duly seconded was approved through the passage of Resolution No. 2026-0425, approving on Second Reading Draft Ordinance No. 039, sponsored by Honorable Bana, entitled: “An Ordinance Prohibiting the Act of Being Naked, Topless or Half-Naked in Public Places,” and for its consideration on Third Reading.
