After a recess, the rules were suspended upon the motion of the Floor Leader who briefly introduced the members of the Board of Directors of the Pagadian City Water District (PCWD).

He also pointed out the distinction between the two (2) submitted Evaluation Report on the Performance of the PAMANA Water Corporation in relation to the stipulations/provisions in the Joint Venture Agreement.

At this point, Mr. Lamberto Talip, Jr., Chairman of the Board of Directors–PCWD, was recognized to ventilate and shed light on the matter. At the outset, he expressed thanks to the 15th City Council for the invitation, as he then discussed, in response to the clarification made by the Presiding Officer, the provisions concerning Capital Expenditures which pertains to the capital investment to be made by the PAMANA which is estimated over P1-Billion for the improvement of the facilities and services and the Operational matter which refers to the operation of the said water utility provider, as provided under the Joint Venture Agreement (JVA) which took effect sometime on October of 2023.

Further into the discussion, while Mr. Talip concurred with the information brought out by Honorable Co that the price of parcels of land at Barangay Tulangan for the establishment of a Water Treatment Plant and at Barangay Poloyagan for Water Storage Reservoir has skyrocketed which is the reason for the delay in the purchase of the said parcels of land, Honorable Co suggested, as a matter of goodwill on the part of the Council, to possibly acquire the parcels of land through expropriation proceedings, to which Mr. Talip stressed that expropriation proceedings would be the last resort in a worst-case scenario. Along with this discussion, Mr. Talip informed the body that under the CAPEX of the JVA, the water treatment plant is the primary reason they entered into the JVA to have enough supply of water for Pagadian City for the next 25 years. Accordingly, the acquisition of the parcels of land should have been accomplished on the first year but, anyway, the PAMANA still has another year to complete the purchase. On the question of system’s loss or accurately referred to as Non-Revenue Water (NRW) brought out by Honorable Co, Mr. Talip replied that NRW are attributed to the water loss due to the use of firetrucks, leaks, flushing of tanks, where based on the Local Water Utility Administration (LWUA), the NWR should only be 20%, but sad to note, the PCWD has incurred 32% NRW before the JVA, and currently it has increased to at least 58%-60%, which means that 40% water supply only has reached the populace.

In response to the query of the Presiding Officer whether the delay in the acquisition of the parcels of land will not affect the timeline and mechanisms for the purpose of solving the perceived water shortage, Mr. Talip informed the body that they had an assurance from the owner of the PAMANA, in the person of Mr. Lucio Co, that PAMANA will deliver what is stipulated in the JVA. Along with that information, Mr. Talip averred that the JVA can be amended after five (5) years from its inception.

Honorable Bana, premised on the objective of the PCWD in entering into JVA with the PAMANA which is, accordingly, to address the perceived water shortage of the City of Pagadian and that the purchase of the parcels of land for the establishment of the water treatment plant is one among the solutions stipulated in the JVA, inquired whether the PAMANA will be penalized for the period they failed to deliver what was stipulated in the JVA, to which Mr. Talip, in response, contended that based on the JVA, the PAMANA could not yet be penalized and no surcharges can be effected for the first three (3) years which is considered as transition period, as he further expressed his commitment to strictly implement the JVA including the provisions of penalty and surcharge in case of failure to comply with the stipulations thereat. On the issue of having enough water source to supply the entire consumers of Pagadian City, Mr. Talip categorically stated that the PAMANA had voluntarily introduced and came up with a catch-up plan where they are currently drilling five (5) wells in Barangays Napolan and Buenavista as a temporary measure to supplement the water supply pending the establishment of the water treatment plant. Furthermore, he stressed that the water produced from the wells is almost the same as the expected water supply from the water treatment plant.

In response to the queries of Honorable Revelo, Mr. Talip detailed that the proposed water treatment plants in Barangays Tulangan and Poloyagan will each produce 10-million liters per day which, according to him, is more than sufficient for the demand including that of the expected increase in population. On the queries posed by Honorable Co, Mr. Talip responded that they are currently serving 25,000 consumer-households or a total of 125,000 people, as he further explained that they are hoping the PAMANA, as part of the JVA, will hasten the institution of the necessary repairs/rehabilitation of the current water pipes to help address the present NRW of 60% and bring down to 20% set by the Local Water Utility Administration (LWUA), which will, in effect, address the water problem of the city for the next 40 years even if the JVA is only for 25 years. Furthermore, on the query whether PAMANA is still liable if they fail to deliver what was stipulated in the JVA notwithstanding the completion of the drillings they are currently undertaking, Mr. Talip answered positively that PAMANA will be liable for penalties and surcharges prescribed in the JVA and, after due process, it will cause the eventual termination of the said JVA.

After Honorable Ronald Christopher Glenn L. Ariosa raised the issue on the re-piping of the water lines to minimize the NRW as he expressed apprehension that the city is fast developing and there is no sufficient water supply, Mr. Talip informed the body that most, if not all, of the water pipes will be replaced as these are almost 50 years old being part of the JVA under Capital Expenditures, which is the reason why PAMANA, due to their substantial losses from water wastage, is now implying the deferment for the establishment of the water treatment plant and instead focus on the re-piping to resolve the current 58% NRW.

As for the request for clarification of the Presiding Officer regarding the Notice of Hearing from the National Water Resources Board for the application of PAMANA for a Certificate of Public Convenience with proposed increased in tariff and drilling sites, Mr. Talip explained that while this a requirement for all private concessionaires operators to secure a CPC, the PCWD chose to ignore the invitation as it is stated within the JVA that it is only the PCWD Board that can approve any tariff increase which will then be passed on to the Local Water Utilities Administration for their approval. Accordingly, he stated that technically, the NRWB has no jurisdiction over this matter, such that they did not acknowledge the invitation as attending the hearing would be tantamount to acknowledging the NRWB had authority over water tariff increases.

At this juncture, Honorable Obaob, upon recognition, gave a brief information on what was really the prevailing problem being brought by the PCWD during the year 2019––the period within which he was then the City Vice Mayor––and that is the replacement of the water pipes which are dilapidated and are now located at the middle of the roads which can be easily broken due to vibration coming from big vehicles passing the roads. He went on further by asking the PCWD’s General Manager whether the establishment of the water treatment plant or the rehabilitation/replacement of water pipes should first be resolved, to which Engr. Pericles Sollano, upon recognition, agreed completely with the observations relayed by Honorable Obaob. For the information of the body, Engr. Sollano narrated the series of events which led them to forego with the idea of obtaining a loan due to interest rates that might affect their office’ operation as well as the consumers who will ultimately suffer the increased water bills. Based on the foregoing circumstances, Engr. Sollano averred that they chose to accept the P1-billion investment offer of Pamana. He also stands corrected that the actual date of the JVA was September 20, 2023. Accordingly, the PCWD had taken into consideration the projected demand for the population growth such that the establishment of the water treatment plant must be taken first which, accordingly, be finished for one (1) year to be followed by the replacement/rehabilitation of water pipes considering that inverting the prioritization would be tedious, impractical and inadequate due to lack of new water source. Following a brief recess to allow some Council Members verify the copies of the 1st and 2nd Performance Evaluation Report they had received, Honorable Obaob sought clarification regarding the catch-up plan, to which Atty. Carlos N. Madarang, member of the BOD of PCWD, succinctly explained that the catch-up plan, as voluntarily initiated by the PAMANA, is just a temporary measure/solution to remedy or address the perceived water shortage. Engr. Sollano, on the other hand, elucidated that failure to implement the JVA after the 3-year transitory period, the PAMANA will be meted with a penalty of 6% for every specified indicator in the performance evaluation and the pre-termination of the JVA will only take place on the 5th year of the contract on the ground that the accomplishment is below 60%. As for the issue on the heavy traffic due to pipelaying works in Barangay Tiguma, which Honorable Obaob observed that the traffic light should have been turned off and traffic aides take over directing traffic, Engr. Sollano reasoned that the delay was caused by a miscommunication with the barangay officials, as he added that future issues must be addressed directly to PCWD for faster solutions rather than to PAMANA.
