Following the suspension of the rules to urgently consider the matter, the body, in consideration of the manifestation of Honorable Lim, Jr. and, upon formal motion presented by the Honorable Floor Leader and duly seconded, resolved to adopt Resolution No. 2025-0024, requesting the Honorable City Mayor to direct the City Engineer to undertake an immediate on-site inspection and technical evaluation on the damaged portions of Gov. Aquino Regional Government Center at Barangay Balintawak, considering the mandate provided under Resolution No. 2019–0147 which, in gist, declared as City Government reserved area all parcel of lands within the Five Hundred (500) meters circumference from the boundaries of the President Corazon C. Aquino Regional Government Center site and thereby, in effect, prohibiting all landowners from constructing residential houses and other structures thereat as well as selling/disposing the same. This will establish a definite point of reference from which the 500–meter radius shall be reckoned with and thereby provide the surrounding lot owners some sort of relief and peace of mind in developing or improving their lots or in disposing or selling their own properties.

Ariosa informed the body on the provisions of Republic Act No. 4136 otherwise known as “Land Transportation and Traffic Code,” which provides a maximum of 99 decibels at 2,000-2,500 rpm regulation on the sound limit for exhaust noise from mufflers. He also stressed the need for the City Government to have a decibel meter as a noise measuring gadget, which contention was echoed by the Honorable Lim, Jr. and the Honorable Culve.

Prior to the referral, Honorable Lim, Jr. provided information that the proposed Dry Goods Night Market is located at Mayor W. E. Pulmones Street from junction F.S. Pajares Avenue up to Duterte Street where, accordingly, there was a problem on the collection due to varying amounts and, presently, the road was no longer used due to flooding brought about by heavy rains, such that he suggested that the body should no longer act on the matter for being moot and academic. While Honorable Ma. Alicia Elena V. Ariosa pointed out the need to refer the matter to an appropriate committee for conduct of study as it would be reckless for the council to disregard this issue. Honorable Revelo, on the other hand, reminded the body of the provision of City Ordinance No. 2k7-265, which strictly prohibits peddling outside the Agora Market.

The body proceeded with the consideration of Resolution No. 03, s. 2025 from the Sangguniang Barangay of Sta. Lucia, entitled: “A resolution requesting the Honorable Sangguniang Panlungsod of Pagadian City to conduct an investigation on the alleged improper removal of vendors and stall owners from their stalls at the Agora Public Market in Barangay Sta. Lucia without due process. The rules were suspended, and after a brief recess, the Floor Leader moved to convert the body as Committee of the Whole.

Following the introduction of attendees, Ms. Lolita Dumaboc, President of the Vegetables & Spices Association, was recognized as she then expressed gratitude to the Council for hearing their concerns. She then started by requesting the Market Supervisor, Mr. Marlon Luzon to answer their question on the notices to vacate issued to them for allegedly not paying dues for five years as their violation while noting that they consistently renewed their business permits annually. She recounted that in 2015, under the administration of then City Mayor Romeo P. Pulmones, they were designated as transient vendors, but during this present administration, under Mayor Samuel S. Co, they were relocated to the burnt area and allowed to have their own stalls and now considered as stall occupants. Furthermore, she intimated that in CY 2022, they were asked to vacate their stalls for the reason that the area will be renovated where the affected vendors were advised to be temporarily relocated, but upon the completion of the renovation, some of the relocated vendors were never allowed to return, as allegedly, Market Supervisor Luzon informed them that the renovated stalls were allegedly assigned to barangay officials. She further revealed that the stalls were allegedly being sold for P350,000.00. Corollary to this, she raised concerns relative to the processing for the issuance of business permit, as she manifested her experience that, in spite of complying with all necessary requirements for the issuance of business permit, the application was denied on the ground of incomplete assessments and alleged violations.

During the interpellation, Ms. Dumaboc, in response to the query of the Presiding Officer, contended that there were seventy (70) stalls being demolished and some of the affected vendors are now renters. On the issue presented by Honorable Revelo relative to her proof showing her being a legitimate stall holder, Ms. Dumaboc showed a copy of a business permit issued for the year 2015 as transient vendors as well as a copy of a business permit for the year 2020 without any designation. On the query relative to the date of the issuance of the notice to vacate and the date of receipt, she replied that it was dated December 2, 2024 and was received by her on December 3, 2024 and the stalls were demolished on December 8, 2024. On the query posed by Honorable Ma. Alicia Elena V. Ariosa, she stated that it was Mr. Marlon Luzon himself who headed the demolition of the stalls.

Initially, Mr. Luzon, in response to the query posed by the Presiding Officer relative to the procedure in acquiring stall in the Agora market, explained that interested person may apply and once the application is approved, the same shall be awarded by the City Mayor and the awardee shall be required to pay a one (1) month advance rent and two (2) months deposit as per contract. At this point, Honorable Lim, Jr. questioned the existence of a transient vendor permit considering that the Market Screening Committee is composed mostly from the Executive Department, to which Mr. Luzon answered that such practice was tolerated and/or permitted by the previous administrations. As regards the query on the total number of transient vendors that were allowed to operate inside the Agora Market, the designated Market Supervisor responded that, per record of their office, there were a total of sixty–four (64) and none of them were awarded a stall in the Agora. He further stated that, at present, only six (6) were left at the Agora market who were operating with a generic business permit issued by the Business and Permits Licensing Office which means no assigned stall, as the others were relocated in Barangay Buenavista market while some are now renting a stall.

During the course of the discussion, Honorable Bana, on the other hand, questioned the demolition made upon the alleged illegal vendors considering that they were issued business permit by the City Government which, accordingly, is tantamount to an authority to engage into a legal business inside the Agora. Furthermore, she averred that the action of the so-called agents of the Local Government Unit of Pagadian in demolishing the temporary stalls installed by the concerned vendors inside the Agora contradicts the very essence of the authority to engage in legal business through the issuance of the business permit. Mr. Luzon, in reaction thereto, clarified that the affected vendors who were identified to have temporarily set up their stalls under the water tank were offered an alternative location in consideration of the clearing operations undertaken by their office, but accordingly, a total of six (6) vendors had refused to vacate and were not able to visit his office for a possible concession. Thereafter, Honorable Bana insinuated that there was a violation of stall ownership rights as she then expressed desire for clarification regarding the issuance of business permits.

Honorable Asugas, upon recognition, raised the issue on the alleged P350-thousand selling price for a stall, to which Mr. Luzon responded that he cannot answer such allegations adding that it is malicious. Furthermore, he elucidated the situation of Ms. Dumaboc who, accordingly, is occupying two (2) stalls in the Agora and is leasing the same stalls in the amount of P300.00 per day, to which Honorable Revelo retorted that subleasing is prohibited and is a clear violation of the provisions of City Ordinance No. 2007–265.

Further into the discussion, the Chair recognized Ms. Daisy Espadilla, another vendor in the Agora market, who then claimed to have paid the amount of P300,000.00 after being approached by Mr. Luzon’s subordinate in exchange of the stall she is currently occupying. She further alleged that the said amount was paid and personally received by Mr. Luzon in his office with no receipt being issued but sad to note, until the present, she was not awarded the stall as promised. At this point, Honorable Co was recognized, as he then addressed the concerns of the affected vendors where he gave assurance that the foregoing predicament will be brought immediately to the attention of the Honorable City Mayor and will work toward the resolution of the matter. He also emphasized the need to reconcile legal and illegal matters surrounding the situation and urged all witnesses to speak truthfully. Finally, he appealed for patience and sobriety as he assured everyone that he would exert his best efforts to help resolve the matter.

Denied
Honorable Obaob, for his part, sought clarity, for recorded purposes, whether Mr. Luzon had received the alleged payment of P300,000.00, to which Mr. Luzon vehemently denied such allegation. Furthermore, he admonished Mr. Luzon in making statements that the stalls had already been awarded to the barangay kagawads, as he also lamented the inaction of Mr. Luzon to have settled the issue at his level in order to preempt the escalation of the matter.

Next recognized was Atty. Alyssa Marie Catalan, representative of the City Legal Office, who then expressed her observation relative to the multiplying/thriving problem confronting the issue at hand. She also concurred with the earlier manifestation of Honorable Bana that the issuance of the business permit legitimizes the vendor’s engagement of trade, however, she reminded the body to be more circumspect on the importance of understanding the legal process concerning the issuance of business permits which is within the sphere of authority of the Business Permits & Licensing Office (BPLO) under Mr. Eamon Siyluy. Furthermore, Atty. Catalan, in response to the request of Honorable Revelo for a copy of the minutes of the Market Screening Committee meeting, stressed that the City Legal Office cannot provide the same as it is only a member of the said committee, as she then directed Honorable Revelo to request from the secretariat of the said committee.

At this juncture, Mr. Eamon P. Siyluy, OIC-Business Permits and Licensing Office, was recognized by the Chair, who then expounded relative to the process of renewing business permits which is done every January of each year with an extension period up to February 28 of the current year. On the issue of his signature in the Notice to Vacate, he clarified that he had signed pre-formatted Notices to Vacate on December of 2024 since the permits of the concerned vendors were about to expire. Furthermore, he explained that only this current year, together with the former City Treasurer, Ms. Nona Duran, and Mr. Marlon Luzon, they had started the process of cleansing out the delinquent vendors from the market with no permits but were still operating. Accordingly, they noticed that some were vendors who were delinquent for a period seven (7) years already, such that he was instructed by Ms. Duran, before she had retired from the service, to investigate stallholders who are selling or subleasing their stalls and to have their licenses revoked. During the deliberation, Mr. Siyluy, in response to the query of Honorable Bana, contended that they will have to coordinate with the City Legal Office for the cancellation of their permits. He also made clarification that only notices were issued and not the cancellation of permits following the manifestation of Honorable Bana that it seems that his office had gone straight to the penalties and were not following what was stipulated under Article 4 of City Ordinance No. 2007-265, which specifically provides for a 1st, 2nd, and 3rd offense.

At this stage, the Presiding Officer suggested to finish this matter in the next session, hopefully some progress has been made with the awarding already done by Mr. Luzon. In answer to the query of Honorable Obaob, Mr. Siyluy disclosed that online processing has not yet been approved at their end. The processing of permits will take one (1) day for those applications that are less than P15-thousand, but the Anti-Red Tape Authority (ARTA) usually takes three (3) days depending on the availability of the City Mayor. He also added that the longest would be 10-15 days. In response to the appeal of Honorable Obaob to avoid delays, Mr. Siyluy clarified that the Chief Executive did not approve the use of the E-signature which would have shortened the process, as he wanted to make sure that the local businesses are being honest about the disclosure of their incomes. Thereafter, and with no further discussion, the matter was calendared for the next session as Unfinished Business.

First was the proposal of Honorable Ma. Alicia Elena V. Ariosa for the rescheduling of the 5th Regular Session to August 6, 2025 to provide the different standing committees of the Sangguniang Panlungsod ample time to study, evaluate and consider the various committee referrals. Following the suspension of the rules to urgently consider the matter, and upon her formal motion and duly seconded, the body supported the proposal through the passage of Resolution No. 2025-0025, scheduling the 5th Regular Session of the Sangguniang Panlungsod (15th City Council) to 06 August 2025.
